Do you own a property with a swimming pool in NSW?

NSW swimming pool safety laws require all properties with a pool or spa to comply with registration and safety inspection requirements.

New laws have come into force that mean all pools in NSW need to be registered before 29 October 2013. Registering your pool online is free, however if you fail to register by the cut off date penalties may apply ($220 fine).

All pools in NSW must be registered on the NSW Swimming Pool Register. Registration is free and helps ensure your pool complies with fencing and barrier safety standards to reduce the risk of accidents, particularly involving young children.

For those without internet access visit your local council (a small fee may apply).

How will this affect my conveyancing?

If you're selling a property with a swimming pool or spa, you are required to obtain a valid Certificate of Compliance (or relevant exemption). This certificate must be attached to the contract for sale.

  • The certificate is valid for 3 years.

  • Without it, your property may not legally be sold.
